SI 2015/1406. The Offshore Installations (Safety Zones) (No. 2) Order 2015. Comes into force 14th July. This Order establishes safety zones having a radius of 500 metres from the specified point around the four installations (which are subsea installations).

SSI 2015/270. The Water Environment and Water Services (Scotland) Act 2003 (Modification of Part 1) Regulations 2015. Comes into force 14th September.

The modifications take account of a number of EU Directives, specifically the Groundwater Directive and the Priority Substances Directive.

R 2015/279. The Marine Conservation (Fixed Monetary Penalties) Order (Northern Ireland) 2015. Came into force 19th June. This Order provides the powers to apply fixed monetary penalties on persons who have contravened byelaws made under section 26 of the Marine Act.

SI 2015/1391. The Environmental Damage (Prevention and Remediation) (England) (Amendment) Regulations 2015. Comes into force on 19th July.

These Regulations make minor amendments to Regulations 6(1), 10(1) and 11(2) of The Environmental Damage (Prevention and Remediation) (England) Regulations 2015 (SI 2015/810).

SI 2015/1393. The Control of Major Accident Hazards (Amendment) Regulations 2015. These Regulations amend The Control of Major Accident Hazards Regulations 2015 (SI 2015/483). Comes into force 13th July.

The amendment makes a minor change to a definition in Regulation 2(1).

This statutory instrument corrects errors in Schedule 1 to The Planning (Hazardous Substances) Regulations 2015. (SI 2015/627).

WSI 2015/1332 (W. 125). The Planning (Listed Buildings and Conservation Areas) (Wales) (Amendment) Regulations 2015. Comes into force 22nd June.

These Regulations amend Planning (Listed Buildings and Conservation Areas) (Wales) Regulations 2012 (SI 2012/793).

The amendment removes the six month time limit for lodging an appeal following the failure of a local planning authority to determine an application for listed building consent.

WSI 2015/1330 (W.123). The Town and Country Planning (Development Management Procedure) (Wales) (Amendment) Order 2015. Comes into force 22nd June.

These Regulations amend the Town and Country Planning (Development Management Procedure) (Wales) Order 2012(SI 2012/810)

The amendment cover a range of aspects including bringing internal operations of a certain size and description within planning control, the maintenance by the Planning Authority of a website for the publication of planning applications and changes to times allowed for determining applications and appeals.

WSI 2015/ 1252 (W. 84). The Common Agricultural Policy Basic Payment and Support Schemes (Wales) Regulations 2015. Came into force 14th May.

These Regulations make provision, in relation to Wales, for the administration of Regulation (EU) No 1307/2013 establishing rules for direct payments to farmers under support schemes within the framework of the common agricultural policy.

SSI 2015/235. The Town and Country Planning (General Permitted Development) (Scotland) Amendment Order 2015. Comes into force 1st October.

The amendment confers permitted development rights for the maintenance, repair or reinstatement of ancient monuments.

SSI 2015/233. The Town and Country Planning (Appeals) (Scotland) Amendment Regulations 2015. Comes into force 1st October.

These Regulations amend the Town and Country Planning (Appeals) (Scotland) Regulations 2013 (SSI 2013/156) to extend the application of those Regulations to appeals under section 5B of the Planning (Listed Buildings and Conservation Areas) (Scotland) Act 1997.

WSI 2015/1331 (W.124). The Town and Country Planning (Referrals and Appeals) (Written Representations Procedure) (Wales) Regulations 2015. Comes into force 22nd June.

These Regulations lay down the procedure and time limits in connection with the determination of certain prescribed applications that are referred to the Welsh Ministers and appeals where the matters are to be considered on the basis of written representations.

SSI 2015/243. The Planning (Listed Building Consent and Conservation Area Consent Procedure) (Scotland) Regulations 2015. Comes into force 1st October.

These Regulations revoke and replace the Town and Country Planning (Listed Buildings and Buildings in Conservation Areas) (Scotland) Regulations 1987 (SI 1987/1529).

These Regulations provide for the procedures to be followed in relation to applications for listed building consent, applications for conservation area consent and applications or variation and discharge of conditions made on or after 1st October 2015.

SI 2015/1352. The Pollution Prevention and Control (Designation of Directives) (England and Wales) Order 2015. Came into force on 4th June.

This Order designates European directives on waste and WEEE for the purposes of paragraph 20(1)(b) of Schedule 1 to the Pollution Prevention and Control Act 1999 (c.24).

SI 2015/1350. The Agricultural or Forestry Tractors (Emission of Gaseous and Particulate Pollutants) and Tractor etc (EC Type-Approval) (Amendment) Regulations 2015. Comes into force 30th June.

These Regulations amend the Agricultural or Forestry Tractors (Emission of Gaseous and Particulate Pollutants) Regulations 2002 (SI 2002/1891) and the Tractor etc (EC Type-Approval) Regulations 2005 (SI 2005/390).

Regulation 2 transposes the changes to Annexes I, II and III to Directive 2000/25/EC and the changes to Annexes I, II and III to Directive 2003/37/EC .

SR 2015/259. The Human Medicines (Amendment) (No. 2) Regulations 2015. These Regulations amend the Human Medicines Regulations 2012 (SI 2012/1916). Comes into force 1st July.

Changes are made to the rules governing the use of electronic prescriptions for products specified in the Misuse of Drugs Regulations

The MMO (Marine Management Organisation) has announced the coming into force of vessel catch limits for bass and a prohibition on retaining bass in the Celtic Sea.

A monthly catch limit will apply depending on the gear(s) a vessel uses: • ICES divisions IVb, IVc, VIId, VIIe VIIf and VIIh • waters within 12 nautical miles from baseline under the soverignity of the United Kingdom in ICES divisions VIIa and VIIg

The limits apply to all vessel lengths and apply to the combined catches from any of the relevant ICES areas during a calendar month. For vessels which use multiple gear types during a calendar month the lowest catch limit for any of those gears used will apply.

The European Chemical Agency(ECHA) has added two new substances of very high concern (SVHCs) to the Candidate List.

The first new entry covers a series of mixed alkyl diesters (EC 271-094-0, CAS 68515-51-5; EC 272-013-1, CAS 68648-93-1) which were added to the list due to their reproductive toxicity properties where they contain ≥ 0.3% of dihexyl phthalate (EC No. 201-559-5). These substances are used for example as plasticisers and lubricants, including use in adhesives, coatings, building material, cable compounding, polymer foils, PVC compounds and artist supply (e.g. modelling clay and finger paints).

The second SVHC has been added as a group entry with very persistent and very bioaccumulative properties. This group of substances covers for example, the product with the trade name "karanal", the main use for which is as a fragrance ingredient.

The European Chemical Agency (ECHA) has announced its support for a French proposal to restrict the placing on the market of bisphenol A–containing thermal paper (e.g., point of sale tickets and receipts). It was considered that the risk for workers (e.g., cashiers) handling thermal paper is not adequately controlled.

The Office of the Government Chemist has announced that following amendments to Annex II to Directive 2011/65/EU – the Waste Electrical and Electronic Equipment (WEEE) Directive. by in Commission Delegated Directive EU 2015/863 the toxic phthalates DEHP, BBP, DBP, DIBP will be restricted for use in electrical and electronic equipment.

These substances have previously been classified as SVHCs, considered harmful to human health, and a maximum concentration of 0.1 % by weight will be established for each of these in EEE. These restrictions come into force at the end of 2016, except for medical devices (including in vitro medical devices) which came into force in 2012.

Laboratories will therefore need to be able to measure these substances accurately in EEE around the 0.1 % level in order to show compliance with the Directive. Both high performance liquid chromatography and gaschromatography-mass spectrometry can be used for such measurements. Experience in our laboratory has shown that often the biggest challenge in the analysis of EEE is the extraction of restricted substances from plastic cabling used in EEE applications.

SI 2015/1386. The Swansea Bay Tidal Generating Station Order 2015. This Order grants development consent for, and authorises Tidal Lagoon (Swansea Bay) plc to construct, operate and maintain, a tidal lagoon generating station in Swansea Bay together with all necessary supporting infrastructure.

Department for Energy and Climate Change (DECC) announced, on the 9th of June, that planning consent had was given for construction of the Swansea Bay Tidal Lagoon, the world’s first tidal lagoon, in a boost to moving towards a low carbon, home grown energy mix.

If built, turbines in the proposed six-mile horseshoe shaped sea wall around Swansea Bay in Wales could generate around 500GWh per year of low carbon electricity.

A study by the University of Wisconsin School of Medicine and Public Health, published online on 18th May in the journal Sleep Health, suggests that shift workers may be more likely to be overweight, have sleep problems, and develop diabetes or other metabolic disorders. Researchers examined data collected between 2008 and 2012 from nearly one thousand six hundred workers in the Survey of the Health of Wisconsin, as well as information about body mass index, Type 2 diabetes and sleep.

They found that nearly half of shift workers (48%) were overweight, compared to 35% of workers on a traditional schedule. Shift workers – who work outside the "normal" 9am to 5pm regime – also were more likely to have sleep problems, including insomnia (24% versus 16%), inadequate sleep (53% vs. 43%) and sleepiness (32% vs. 24%).

Having sleep problems was connected with being overweight, obese or diabetic, and the connection appeared to be stronger in shift workers who slept fewer than seven hours – suggesting that adequate sleep can help reduce negative metabolic consequences of shift work, a press release states.

An Oxfordshire haulage company owner and the landowner of a mushroom farm have been ordered to pay a total of £21,000 in fines and costs for illegally depositing 3000 tonnes of illegal waste at the farm’s site in Bampton.

The Environment Agency alleged that the waste had been mis-described in order to justify its use as a growing medium compost for a mushroom farm and to avoid higher legitimate disposal fees.

The farmland did not have an environmental permit or the relevant exemption for the waste to be deposited. The waste carriers failed to exercise due diligence in ensuring that waste had been properly described or that the farmer had an environmental permit or an exemption for the waste to be deposited there.

A Sussex NHS Hospital Trust was fined £50,000 and order to pay £38,706 for failing to control Legionella.

The prosecution followed the death of a vulnerable patient.

The court was told that although the Trust was monitoring legionella and water temperatures across its various sites between October 2010 and November 2011 a total of 114 positive legionella tests and a further 651 records of water temperatures outside the required parameters were not adequately acted upon.

A Leicestershire aluminium fabrication company was was fined £140,000 and ordered to pay £32,251.31 in costs after a worker was crushed under a lifting truck which tipped over while lifting extruder dies from storage racks. He suffered fatal chest and abdominal crush injuries and died from his injuries in hospital the next day.

HSE stated that the incident stemmed from three material breaches of health and safety law. These were inadequate risk assessment for collecting and replacing dies in storage racks, an inadequate safe system of work for the use of a Narrow Aisle High Level Reach Truck and the company’s organisation of lifting operations in the die storage area.
