Brings into force on 31st July Section 50 of the Infrastructure Act (A 2015 c. 7) for the purpose of defining “protected groundwater source areas” and “other protected areas” in section 4A of the Petroleum Act (A 1998 c. 17)

EU 2015/1221. Commission Regulation amending Regulation (EC) No 1272/2008 on classification, labelling and packaging of substances and mixtures.

The amendment takes account of technical and scientific progress specifically with regards to the hazards associated with the use of nitric acid and phenol.

The Regulation also introduces a new and updated harmonised system for classification and labelling of certain substances. Comes into force 1st January 2017.

WSI 2015/1417. The Hazardous Waste (Miscellaneous Amendments) (Wales) Regulations 2015. Came into force 20th July. These Regulations amend certain statutory instruments concerned with hazardous waste, which refer to the List of Wastes (Wales) Regulations 2005 (SI 2005/1820) or to European Union enactments concerning hazardous waste.

• Regulation 2 of these Regulations amends the Landfill Allowances Scheme (Wales) Regulations 2004 (SI 2004/1490) • Regulation 3 and the Schedule make amendments to the Hazardous Waste (Wales) Regulations 2005 (SI2005/1806) • Regulation 4 amends the Environmental Permitting (England and Wales) Regulations 2010 • Regulation 5 amends the Waste (England and Wales) Regulations 2011 (SI.2011/988) • Regulation 6 amends the Controlled Waste (England and Wales) Regulations 2012 (SI 2012/811), • Regulation 7 revokes the List of Wastes (Wales) Regulations 2005 (SI 2005/1820

SI 2015/1553. The Pyrotechnic Articles (Safety) Regulations 2015. Comes into force 17th October.

These Regulations transpose Directive 2013/29 on the harmonisation of the laws of member States relating to the making available on the market of pyrotechnic articles and Commission Implementing Directive 2014/58/EU setting up a system for the traceability of pyrotechnic articles.

This Order is one of a series of Orders implementing Directive 2005/65/EC on enhancing port security at individual ports in the United Kingdom. Article 2 and Schedule 1 define the boundary of the Port of Oban.

EU 2015/1116. Commission Implementing Regulation approving the basic substance lecithins, in accordance with Regulation (EC) No 1107/2009 and amending the Annex to Commission Implementing Regulation (EU) No 540/2011. Comes into force 29th July.

SI 2015/1487. The Aggregates Levy (Registration and Miscellaneous Provisions) (Amendment) Regulations 2015. Comes into force 1st August. These Regulations amend the Aggregates Levy (Registration and Miscellaneous Provisions) Regulations 2001 (SI.2001/4027) to take account of the restoration of certain exemptions from the aggregates levy provided for in section 17(3) and (4) of the Finance Act 2001.

SI 2015/1459. The Renewable Heat Incentive Scheme and Domestic Renewable Heat Incentive Scheme (Amendment) (No. 2) Regulations 2015. Regulations 4, 9 and 11 to 13 come into force on 26th September. All other regulations came into force on 27th July. These Regulations amend The Renewable Heat Incentive Scheme Regulations 2011 (SI 2011/2860) and The Domestic Renewable Heat Incentive Scheme Regulations 2014 (SI 2014/928).

SI 2015/1431. The Pollution Prevention and Control (Fees) (Miscellaneous Amendments and Other Provisions) Regulations 2015. Coming into force 22nd July. These Regulations set fees relating to The Merchant Shipping (Oil Pollution Preparedness, Response and Co-operation Convention) Regulations 1998, The Offshore Installations (Offshore Safety Directive) (Safety Case etc.) Regulations 2015, The Fluorinated Greenhouse Gases Regulations 2015, The Offshore Marine Conservation (Natural Habitats etc.) Regulations 2007 and certain marine licensing applications. They also amend The Offshore Petroleum Production and Pipelines (Assessment of Environmental Effects) Regulations 1999 (SI 1999/350) and The Offshore Petroleum Activities (Conservation of Habitats) Regulations 2001 (SI 2001/1754).

SI 2015/1469. The Water Act 2014 (Commencement No. 4 and Transitional Provisions) Order 2015. This Order is the fourth commencement order made under the Water Act 2014 (c.21) . Article 2 brings into force on 15th July provisions which set out the process by which the Water Services Regulation Authority (“Ofwat”) is to produce its charging rules. Article 3 brings into force on 1st September provisions which set out the procedure Ofwat must follow when issuing rules about charges which may be levied by water and sewerage undertakers. Article 4 brings into force on 1st November the remainder of section 16 (charges schemes) which removes the requirement for Ofwat pre-approval of water and sewerage undertakers’ charges schemes.

SR 2015/286. The Common Agricultural Policy Direct Payments and Support Schemes (Cross Compliance) (Amendment) Regulations (Northern Ireland) 2015. Comes into force 1st August. These Regulations amend the Common Agricultural Policy Single Payment and Support Schemes (Cross Compliance) Regulations (Northern Ireland) 2014 (SR 2014/ 291). The Regulations amend the principal Regulations by- (a) permitting a farmer to put measures in place to limit soil erosion where soil or weather conditions prevent a crop being sown); (b) removing the requirement that residues of crops harvested after 1st November are not disturbed until just before sowing the spring crop on the land (c) extending the period during which a derogation may be obtained for a ploughing match, (d) permitting the Department of Agriculture and Rural Development to authorise hedge, tree or scrub cutting, trimming or laying between 15th August and 31st August

Department of Energy and Climate Change (DECC) released the provisional monthly energy statistics for the three month period March to May 2015. Compared to the same period a year earlier

a) Primary energy consumption in the UK on a fuel input basis rose by 2.4%, on a temperature adjusted basis it fell by 1.8%. b) Indigenous energy production rose by a record 6.2% boosted by increased UKCS production with oil up 5.2% and gas up 6.5%. c) Coal provided 29.7% of electricity generation by Major Power Producers, with gas at 28.0% and nuclear at 22.5%. d) Wind generation by Major Power Producers up 31% due to higher wind speeds, whilst overall renewables up 39% with growth in biomass e) Low carbon share of electricity generation by Major Power Producers up 6.9 percentage points to 42.2%, due to rise in renewables generation

DEFRA announced that British shoppers took 8.5 billion single-use carrier bags from major supermarkets in 2014. The number of plastic bags taken from supermarkets has increased for the fifth year running – despite research from the Department for Environment, Food and Rural Affairs showing that the average household already has 40 plastic bags stashed away around the home.

Plastic bags can take years to fully decompose and even though household recycling rates have improved significantly in recent years, 16,000 tonnes of waste still goes to landfill every year. Around 8 million tonnes of plastic also ends up in our oceans each year, polluting our marine environment and harming our precious sea life.

Preesall underground gas storage facility receives planning consent

The Energy Minister Lord Bourne today granted planning consent for the Preesall Underground Gas Storage Facility project.

The facility is proposed to be constructed on the east side of the Wyre Estuary at Preesall in Lancashire and will be used to store and extract gas from local underground salt caverns. The project may create up to three hundred jobs during construction and up to forty permanent jobs once operational.

Following a review of the list of restricted substances under the Restriction on the use of Certain Hazardous Substances in Electrical and Electronic Equipment Directive[RoHS], the European Commission has now published Commission Delegated Directive (EU) 2015/863. This legislation provides an amendment to Annex II of RoHS (2011/65/EU) and confirms the inclusion of four new restricted substances.

The additional substance restrictions and maximum concentration values (outlined below) will come into force from 22 July 2019: • bis (2-ethylhexyl) phthalate (DEHP) (0.1 %) • butyl benzyl phthalate (BBP) (0.1 %) • dibutyl phthalate (DBP) (0.1 %) • diisobutyl phthalate (DIBP) (0.1 %)

SI 2015/1561. The Preesall Underground Gas Storage Facility Order 2015. This Order authorises Halite Energy Group Limited to construct and operate an underground gas storage facility and associated infrastructure in Preesall, Lancashire.

SI 2015/1570. The Progress Power (Gas Fired Power Station) Order 2015. This Order authorises Progress Power Limited to construct, operate and maintain gas fired electricity generating station, with a nominal generating capacity of up to 299 MW, at Eye Airfield Industrial Estate in Suffolk.

SI 2015/1574. The Hirwaun Generating Station Order 2015. This Order authorises Hirwaun Power Limited to construct, operate and maintain a gas fired electricity generating station, with a nominal generating capacity of up to 299 MW, at Abadare, South Wales

Department of Energy and Climate Change (DECC) has published a draft of The Onshore Hydraulic Fracturing (Protected Areas) Regulations 2015.

This regulation defines “protected groundwater source areas” and “other protected areas” - land at a depth of less than 1,200 metres beneath National Parks, the Norfolk Broads, areas of outstanding natural beauty and World Heritage sites.

2nd July. The European Chemical Agency (ECHA) has proposed that fifteen substances of very high concern (SVHCs) are recommended to be added to the REACH Authorisation List. These substances were prioritised from the Candidate List because they are used in high volumes and have widespread uses which may pose a threat to human health or the environment or can potentially be used to replace substances which are already on the Authorisation List. The fifteen substances are classified as carcinogenic or toxic for reproduction. Two substances are in addition very persistent, very bioaccumulative and toxic (PBT and vPvB). The revision to the Code of Practice: a. explains the legislative requirements of the duty of care, and make clear who and what they apply to; b. provides guidance so that each user understands how to demonstrate compliance with the duty of care; c. identifies other legislative requirements that apply to the management of waste and must be complied with alongside the duty of care in particular circumstances;

The Cabinet Office is carrying out a review to identify unnecessary barriers to growth and productivity in the waste sector.

It is seeking evidence of barriers in the law, how it is implemented and enforcement activity which is carried out on the ground. It aims to identify ways of removing unnecessary barriers whilst also maintaining the protection of human health and the environment.

20th July. DECC is consulting on proposed legal drafting for the Smart Energy Code, or gas and electricity supply licences, to support smart metering. Consultation closes on 1st September.

The consultation seeks any comments on proposed legal drafting on a number of topics to be added to the regulatory framework for smart metering. These include: • the licence condition requiring enrolment of SMETS2 meters with the Data and Communications Company (DCC) • subsidiary documents concerning DCC enrolment and communications services (previously at sections H4, H5 and H6) • further activation of the SEC modification process • requirements relating to incident management, public key infrastructure and smart metering testing • revisions to independence requirements of the organisation performing security and privacy assessments of DCC users • obligations relating to the installation, maintenance and removal of communications hubs.

Prosecutions

A national construction firm and a glazing contractor have each been fined £200,000 and ordered to pay £17, 790 costs after a worker fell to his death from a store front in Exeter.

Falling approximately 4.5metres through the canopy on to the granite setts below, he received serious injuries and died later in hospital.

An investigation by the HSE found that the mobile platform provided was inadequate for the work being carried out. The glass canopy on which he was working was not a safe working platform as there was no edge protection and there was the large opening through which he subsequently fell.
